CONCERNING
AMENDMENT TO THE ATTACHMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE No. 558/MPP/KEP/12/1998 ON EXPORT GENERAL PROVISIONS AS ALREADY AMENDED SEVERAL TIME AND THE LATEST BY REGULATION OF THE MINISTER OF TRADE No. 07/M-DAG/PER/4/2005

THE MINISTER OF TRADE OF REPUBLIC OF INDONESIA,

Considering:

a. that in developments, environmental damage is attributable to the uncontrollable mining of sand, soil, and top soil (including surface soil) as a result of illegal export of sea sand, rampant export of other sand, export of soil and export of top soil so that in a bid to anticipate the worst environmental damage, it is deemed necessary to add other kinds of sand other than sea sand, soil, and top soil (including surface soil) as goods forbidden to export;
b. that in the framework of minimizing the environmental damage arising from the mining of tin ores and uncontrollable activity of tin smelter as well as in a bid to support Indonesian economy, especially for the issues related to the fostering and development of mining business, processing and purification of tin ores, as well as trade, it is deemed necessary to add tin bar as goods whose export is regulated;
c. that since precursors, which should be only used in the pharmaceutical and non-pharmaceutical sectors are misused for becoming raw materials/auxiliary materials of narcotics and psychotropic production illegally, it is deemed necessary to add precursors as goods whose export is regulated;
d. that based on the considerations as intendedintended in sub-paragraphsub-paragraph a, b and c, it is necessary to amend to Attachment to Decree of the Minister of Industry and Trade No. 558/MPP/KEP/12/1998 on Export General Provisions as has already been amended several time and the latest by Regulation of the Minister of Trade No. 07/M-DAG/PER/4/2005;
e. that based on the considerations as intended in sub-paragraph a, b, c and d, it is necessary to stipulate a regulation of the Minister of Trade;

In view of:

1. Trade Ordinance of 1934 (Statute Book of 1938 No. 86) as has already amended and supplemented;
2. Law No. 8/Prp/1962 on Trade of Goods Under Supervision (Statute Book of 1962 No. 42, Supplement to Statute Book No. 2409);
3. Law No. 11/1967 on Mining Basic Provisions (Statute Book of 1967 No. 22, Supplement to Statute Book No. 2831);
4. Law No. 7/1994 on Ratification of the Agreement Establishing The World Trade Organization (Statute Book of 1994 No. 57, Supplement to Statute Book No. 3564);
5. Law No. 10/1995 on Customs Affairs (Statute Book of 1995 No. 75, Supplement to Statute Book No. 3612) as has already been amended by law No. 17/2006 (Statute Book of 2006 No. 93, Supplement to Statute Book No. 4661);
6. Law No. 8/1996 on Ratification of Convention on Psycho tropics Substances 1971 (Psycho tropics Convention 1971) (Statute Book of 1996 No. 100, Supplement to Statute Book No. 3657);
7. Law No. 5/1997 on Psycho tropics (Statute Book of 1997 No. 10, Supplement to Statute Book No. 3671);
8. Law No. 7/1997 on Ratification of the United Nations Convention Against Illicit Traffic in Narcotic Drugs and Psychotropic Substances 1988 (Statute Book of 1997 No. 17, Supplement to Statute Book No. 3673);

13. Presidential Regulation No. 9/2005 on the Status, Tasks, Function, Organizational Structures and Working Arrangements of State Ministries as already amended by Presidential Regulation No. 90/2006;
14. Presidential Regulation No. 10/2005 on First-Echelon Organizational Units and Tasks of State Ministries as has already been amended several time and the latest by Presidential Regulation No. 66/2006;
15. Decree of the Minister of Health No. 917/MENKES/SK/VIII/1997 on Kinds of Psychotropic Precursors;
16. Decree of the Minister of Health No. 890/MENKES/SK/VIII/1998 on Kinds of Narcotic Precursors;
17. Decree of the Minister of Industry and Trade No. 558/MPP/KEP/12/1998 on Export General Provisions as has already been several time and the latest by Regulation of the Minister of Trade No. 07/M-DAG/PER/4/2005;
18. Regulation of the Minister of Trade No. 01/M/DAG/PER/3/2005 on Organization and Working Arrangement of the Ministry of Trade as has already been amended by Regulation of the Minister of Trade No. 30/M-DAG/PER/12/2005;

Observing:

Results of Ministerial Plenary Meeting (RPTM) on January 18, 2007 at the Office of the Coordinating Minister for Politics, Law, and Security regarding Policy on the Export of Sand, Soil, and Top Soil (including surface soil).

HAS DECIDED:

THE REGULATION OF THE MINISTER OF TRADE ON THE AMENDMENT TO THE ATTACHMENT TO DECREE OF THE MINISTER OF INDUSTRY AND TRADE No. 558/MPP/KEP/12/1998 CONCERNING EXPORT GENERAL PROVISIONS AS ALREADY AMENDED SEVERAL TIME AND THE LATEST BY REGULATION OF THE MINISTER OF TRADE No. 07/M-DAG/PER/4/2005.

Article I

1. To amend the Attachment to Decree of the Minister of Industry and Trade No. 558/MPP/KEP/12/1998 on Export General Provisions as already amended several times and the latest by Regulation of the Minister of Trade No. 07/M-DAG/PER/4/2005 by supplementing:

a. kinds of other sand other sea sand, soil and top soil (including surface soil) as goods forbidden to export; and
b. precursors and tin bar as goods whose export is regulated, so as to become as contained in the attachment to this regulation.

2. Prohibition on the export of sand, soil and top soil (including surface soil) as intended in point 1 letter a shall start applying on February 6, 2007.

3. Regulation of the export of tin bar as intended in point 1 letter b shall start applying on February 23, 2007.

4. Regulation of the export of precursors as intended in point 1 letter b shall start applying on February 23, 2007.

Article II

The regulation shall come into force as from January 23, 2007.

For public notice, the regulation shall be published in State Gazette of the Republic of Indonesia.
